Terms and agreements

Our privacy policy, website terms and client project agreement, together in one place.

Last updated October 14, 2026.

Privacy policy

How we handle information, who can access it, and the choices you have.

01Who we are

FusionWeb is operated by Isaias Tsehaye Haile as a sole proprietor based in Victoria, British Columbia. Isaias is our privacy lead. Contact hello@fusionweb.ca with privacy questions or requests.

02Information we collect

We collect information you provide when enquiring about or commissioning a website: contact and business details, goals, preferences, budgets, timelines, reference links, project content, correspondence, agreements, billing records and website-management details such as domain ownership and hosting providers.

Technical information may be processed by our hosting services to operate and protect the website. Do not submit passwords, payment-card details, medical records or identity documents through our enquiry form.

03Why we use information

  • Respond to enquiries, organize project requirements, prepare introductory calls, follow up about requested projects, and prepare quotes and agreements.
  • Design, deliver, host, maintain and support the agreed website.
  • Manage billing, business records and legal obligations.
  • Improve customer service through feedback and enquiry trends, using aggregated or de-identified information where practical.
  • Protect our services against misuse.

04Optional promotional emails

Promotional emails are separate from project enquiries. The marketing choice is optional and unchecked by default. Declining does not affect quotes or service. We use your marketing details only when we have valid consent.

You can unsubscribe using the instructions in a promotional email or by contacting hello@fusionweb.ca. We retain the minimum consent and suppression information needed to demonstrate consent and respect your choice. Necessary project communications remain separate.

05Access and service providers

Authorized employees and contractors receive access only when their assigned work requires it and are subject to confidentiality obligations. Contractors need our approval before sharing information with another person or service.

  • Netlify: hosting, enquiry processing and private website submission storage.
  • Resend: enquiry confirmations, booking invitations and internal project-preparation email delivery.
  • Google Sheets: a private enquiry tracker containing submitted project details, contact information, internal summaries and follow-up notes.
  • Google Calendar and Google Meet: introductory-call scheduling, booking details and video-call links.
  • Porkbun email service: our business mailbox and correspondence.

We do not sell personal information or share it with other businesses for their own marketing. Disclosures may also occur where authorized or required by law.

06Processing outside Canada

Authorized workers and providers may process information outside Canada. We require confidentiality and security safeguards and limit access to necessary work. Information processed abroad may be subject to foreign laws and lawful access by authorities.

07AI-assisted tools

FusionWeb may use AI-assisted tools to support design, development, content preparation and quality review, including preparation of project documents. FusionWeb remains responsible for reviewing the work. Client customer records, passwords, API keys and other sensitive information will not be entered into AI tools. Ordinary business and project information may be used where appropriate to the agreed work and applicable privacy obligations.

08Clients’ customer information

We do not routinely access clients’ customer booking, order or enquiry records. Explicit client authorization for the specific task is required whether records are provided directly or accessed in the client’s system. We follow documented instructions, use them only for that task, and never use them for FusionWeb promotions.

Sensitive information requires explicit authorization for a specific task and a separate privacy and security review. We may decline work if suitable protections cannot be established. Before any such task, we agree on access, safeguards and deletion instructions, including a target of deleting temporary copies within 30 days after the task ends, sooner if instructed, unless legally required to retain them.

09Retention and deletion

RecordRetention target
Unsuccessful enquiriesTarget: review retained email copies and summaries for deletion 12 months after last contact.
Active clientsKeep information necessary to deliver and manage services.
Routine correspondence after services endTarget: review for deletion after 12 months, subject to legal requirements or an ongoing dispute.
Service copies after care endsTarget: review for removal within 30 days after the agreed handover or service end, except records needed for legal, accounting or dispute purposes.
Temporary customer-data copiesTask-specific deletion instructions are agreed before access is provided.
Invoices and tax recordsApplicable statutory periods; generally six years from the end of the relevant tax year.
Marketing recordsMinimum records needed to manage consent and honour unsubscribe requests.

Email, Google tracker, calendar and project-file retention is currently handled manually, and not all scheduled deletion processes are established. The targets above guide retention reviews; copies may remain until reviewed. Contact us to request access, correction or deletion, subject to applicable legal requirements.

Current website storage is shorter: PDF download links expire after seven days and stored submissions are scheduled for deletion after 30 days. Email copies and Google tracker or calendar records are separate and are not removed by the website’s 30-day cleanup. Mandatory retention periods take precedence; information used for a decision directly affecting an individual may need to be retained for at least one year.

10Browser storage and analytics

The site stores your motion preference in browser storage. Enquiry drafts stay in your browser tab so answers are retained while you move between steps. You can use Clear draft to remove saved enquiry answers. Download summary sends your current answers to our PDF service to generate a document; it does not email an enquiry.

We do not currently use optional analytics, advertising trackers or session recordings. We will describe any future analytics data, retention and consent controls before enabling it.

External fonts and showcase images may make requests to their providers when loaded. These requests can disclose technical details such as your IP address to those providers. Our hosting service may also process technical logs to operate and protect the site.

11Security and incidents

Access is permitted only for agreed work. Individual accounts, multi-factor authentication and staff or contractor access controls are being established and are not yet implemented across every service. Appropriate access and confidentiality arrangements must be established before additional workers receive personal information. Do not send passwords through the enquiry form or ordinary email. Suspected loss, unauthorized access or disclosure should be reported to our privacy lead.

If FusionWeb becomes aware of suspected or confirmed unauthorized access to, disclosure of or loss of the client’s personal information, it will notify the client promptly, share the information then known and provide updates as the response develops. FusionWeb will take reasonable steps to contain the incident and cooperate with the client’s response. Notices to individuals or authorities will be handled as required by law and coordinated where appropriate. This does not create a continuous monitoring service. No system can guarantee complete security.

12Your choices and requests

Contact hello@fusionweb.ca to request access, correction, withdrawal of optional consent or deletion of information no longer needed, or to raise a concern. We may reasonably verify identity and will explain legal exceptions or service consequences where applicable. Deletion is not unconditional where records must legally be retained.

For customer records controlled by one of our clients, contact that business. We can assist on its instructions where authorized.

13Updates and privacy concerns

We identify policy updates by date and provide further notice or obtain consent where required for material changes.

If you have any privacy concerns, please contact us at hello@fusionweb.ca.

Website terms of use

The ground rules for browsing FusionWeb and exploring the website examples.

01About these terms

These terms concern browsing FusionWeb, operated by Isaias Tsehaye Haile in Victoria, BC. Website projects are governed by a separate written agreement.

02Example websites and real enquiries

Showcase websites use sample businesses, content, listings and pricing. Bookings, payments and enquiries inside those examples are simulations; they do not create transactions or send business messages. FusionWeb’s own project enquiry form sends a real enquiry when connected to the live service.

03Starting a project

Submitting an enquiry does not create a contract, confirm a price or reserve a launch date. Scope, pricing and scheduling are confirmed in a separate written agreement.

04Advertised pricing

Starting prices are a guide to an available starting scope, not a price for every showcased feature. Final pricing depends on agreed scope and is confirmed in writing before work begins. Applicable taxes and approved third-party costs are identified in the quote. Advertising must reflect a service genuinely available at the stated price.

05Showcase content and licences

You may browse and share links to examples. Copying, republishing or using designs, code, images or branding requires permission from the relevant rights holder, except where permitted by applicable law or licence. Third-party materials retain their own licence terms; FusionWeb does not claim exclusive ownership of every asset.

06Acceptable use

Do not submit spam or unlawful content, impersonate others, attempt unauthorized access or interfere with the website’s operation.

07Third-party links and services

External websites and services operate under their own terms and privacy policies. FusionWeb does not control their content, availability or practices. This does not exclude FusionWeb’s responsibilities for its own services.

08Accuracy and availability

We aim to keep the site accurate and available, but errors, interruptions and updates may occur. Examples illustrate possible designs and features and do not guarantee business results. Project deliverables are specified in the client agreement.

09Changes and legal rights

We may update website terms and will identify the effective date. Changes do not automatically amend an existing client agreement. Nothing here is intended to remove rights that cannot lawfully be excluded.

10Questions and concerns

If you have questions or concerns about these website terms, contact hello@fusionweb.ca.

Client project agreement

How we agree on scope, payments, support and a fair handover.

01Project details and written scope

FusionWeb is operated by Isaias Tsehaye Haile in Victoria, BC. This page explains our project terms; it is not a signed contract. Each project requires its own written agreement identifying the legal parties, addresses, authorized representative and cost-approval authority, proposal reference and version.

The proposal records the exact page count and page list, distinct layouts, features, integrations, content responsibilities, acceptance checks, exclusions, total price and applicable taxes, external costs, dates and selected care plan. Features and complexity can affect the package and final price. Growth’s 20+ pages is not an unlimited-page commitment.

Canadian business and personal-use projects require the applicable project-specific terms. Personal-use projects need the relevant provincial consumer disclosures and cancellation provisions before acceptance. Rights that cannot lawfully be excluded are preserved.

02Package scope and revisions

Ultra Light starts at $499 CAD for up to 3 pages and 1 consolidated revision round. Launch starts at $999 CAD for up to 10 pages and 2 rounds. Business starts at $1,699 CAD for up to 20 pages and 4 rounds. Growth starts at $2,499 CAD for 20+ pages with an exact agreed scope and 6 rounds. Applicable taxes are additional; hosting and ongoing care are separate.

Every package includes About Us content, a standard contact form, mobile-friendly layouts, basic search titles and descriptions, a working preview, checks of agreed links and forms, and written launch approval. About Us counts as a page when it has its own page. A contact form may be placed on an included page; a separate Contact page counts toward the agreed page total.

Growth’s 20+ pages describes suitability for larger sites, not an unlimited-page commitment. Before signing, list the exact number and names of pages, distinct layouts, content entries, features and integrations in the proposal. Any later additions or new layouts need a written change approval. Custom dashboards, custom ordering backends and complex applications are outside the standard packages.

03Build payments

An upfront deposit of 1/3 of the total project price is due after signing to reserve the agreed start date and before work begins. The remaining 2/3 is due after the agreed work has been reviewed and approved, before launch or handover. The quote remains open for 30 days from issue. Record payment amounts to the cent, with the final balance adjusted for rounding. All amounts and approved extra charges are confirmed in writing.

04When work starts

The project starts when FusionWeb begins substantive work on the signed scope, after receiving the deposit and confirming the start in writing. Signing, receiving the deposit, the introductory call and preliminary enquiry concepts do not alone mean work has started. A reserved start may be later than the deposit date; FusionWeb will communicate the agreed start and any revised schedule.

05Project stages and completed work

Stage values make completed work measurable if the client cancels. They are agreed before signing and do not change the payment schedule of 1/3 upfront and the remaining 2/3 before launch or handover.

Planning, design, development, and testing and launch preparation each have a value agreed in the proposal. Before signing, price the sub-deliverables within each stage; all stage values must total the agreed build fee before tax. Partial-stage charges use documented completed sub-deliverables, capped at that stage’s value. Preliminary enquiry work is not charged retroactively, and no undisclosed hourly cancellation rate applies.

06Feedback and revisions

Ultra Light includes one consolidated revision round, Launch two, Business four and Growth six within the agreed scope. A round is one combined list of feedback across the project, collected by the client’s decision maker. Design and working-preview reviews share this allowance; preview review does not create additional rounds. Correcting defects or work that does not meet the agreed deliverables does not consume a round.

To help keep delivery timely, provide one consolidated feedback list within five business days of receiving a design or website preview. If more time is needed, tell FusionWeb and we will agree an extended review deadline. We will explain any effect on delivery and confirm revised dates in writing. Silence is not approval.

07Written changes and client inputs

New pages, features, additional rounds or changes to an approved direction require a written description, price and schedule impact. FusionWeb and the named authorized representative must approve the change and any additional costs before that work begins. Use the change format at the end of this agreement. Feedback from another contact does not authorize charges.

The client supplies agreed content, licensed assets and authorized access by the proposal dates. Delays may move launch; FusionWeb explains the effect and confirms revised dates. After 30 days without required material or feedback, FusionWeb sends a written reminder and may pause work. Restart timing depends on availability; any extra fee requires prior approval. A pause is not a cancellation and does not create a new forfeiture or fee.

08If the client cancels the build

If the client cancels before work starts as defined above, FusionWeb refunds all project payments received. After work starts, the 1/3 deposit is non-refundable, subject to applicable law. The deposit is credited toward completed work, not charged in addition to it.

For a client cancellation after work starts, the build amount payable is the greater of the 1/3 deposit and the value of completed work under the agreed priced stages and sub-deliverables. Compare both amounts on the same tax-inclusive basis. Completed-work charges cannot exceed the agreed build fee plus approved scope additions and applicable taxes. Unperformed work is not charged beyond the retained deposit. Separately approved, non-recoverable external costs actually incurred may also be payable, with no duplicate charge for costs already included in a deliverable.

FusionWeb will provide an itemized settlement showing completion evidence, approved costs and all payments credited. Any remaining amount for completed work and approved costs is payable; any overpayment is refunded. For a $999 project where no tax applies, a $333 deposit against $600 of completed work leaves $267 payable, not an additional $600.

09If FusionWeb cancels the build

If FusionWeb cancels the build agreement, it will refund all payments received under the build agreement in full. This does not include fees for separately supplied ongoing care. Refunds are issued within 14 calendar days, or sooner where law requires. Cancellation and non-refundable wording do not override rights or remedies that cannot lawfully be excluded.

10Ownership and handover

The client retains ownership of its pre-existing and supplied materials at all times. Ownership of transferable custom work created specifically for this project passes to the client after full payment. FusionWeb retains pre-existing tools and reusable components and grants a continuing licence to use and maintain them within the delivered site, including through another developer. Third-party and open-source licences still apply. Domains are registered in the client’s name; management access is provided only when needed. Each party is responsible for permissions for the materials it supplies.

Basic handover includes the agreed site files, client-owned assets, build and operating instructions, hosting requirements, integrations, licences, recurring costs and account ownership. After early cancellation, client-owned materials are returned and handover of paid-for usable deliverables is identified in the settlement. Agency-wide accounts and shared passwords are not released.

Booking, shop or payment integrations require project-specific instructions for availability, products, stock, orders and refunds as relevant. Any agreed admin or staff roles, export arrangements and operating limits are documented. These instructions do not add a custom backend or features outside the signed scope.

11Managed hosting and client accounts

If ongoing care is selected, FusionWeb manages the website in a separate project under its Netlify team. Launch does not automatically transfer that project to a client-owned hosting account. Domains and the client’s payment, booking, email and other business-service accounts remain client-owned. State each provider, fee and renewal responsibility in the proposal.

Where project access is needed, use named accounts and the access appropriate to the task. A client may be invited using their own Netlify login to enter project credentials where the platform permits; a separate paid client Netlify subscription is not included or automatically required. Temporary access is reduced or removed when no longer needed. Provider permissions and plan requirements must be checked when access is arranged.

Do not send passwords or API keys through the project brief, email or change form. Integration secrets required by the website must use an agreed protected server-side configuration method. Account recovery passwords remain with their owners. Contractors receive only access needed for assigned work.

12Moving to another provider

The client may appoint another provider. Basic handover is as described above; migration, hosting transfer, reconnection and testing are included only if expressly agreed. Agree responsibilities, timing and any additional fee in writing before transfer work starts. Third-party licences and platform transfer limits still apply.

13Review launch and corrections

FusionWeb provides a working preview for review and corrects issues that fail to meet the agreed scope. Written client approval and final payment are required before launch or handover. A 30-day period after launch covers defects in FusionWeb’s agreed work. New content, extra features and issues caused solely by later changes or external services are separate. This period does not limit rights that cannot lawfully be excluded.

14Monthly care plans

PlanMonthly priceTotal monthly upkeep time
Website Care$29 CAD + applicable taxesUp to 30 minutes per billing month
Website Care Plus$59 CAD + applicable taxesUp to 60 minutes total per billing month

Care is optional and becomes payable only when selected in the signed proposal.

The selected plan includes managed Netlify hosting for the agreed site and basic upkeep within one combined monthly time allowance. Upkeep includes checking main links and forms, updating supplied text and photos, opening hours and similar changes within existing pages. It does not include new features, redesigns, continuous monitoring or security audits. Domain renewals, email, paid tools and other subscriptions are separate. Any increased usage requiring additional hosting charges must be explained and approved before those charges are passed to the client.

Actual upkeep and content-update time is recorded and available to the client. The 30 or 60 minutes is the total monthly allowance, not separate allowances for each task. Unused time does not roll over. FusionWeb tells the client before the allowance is exceeded; extra work needs written approval. Correcting FusionWeb’s own errors in agreed maintenance work does not consume the allowance.

15Care billing support and cancellation

Care is billed monthly in advance from the agreed service start and is due on the renewal date. For unpaid care fees, FusionWeb sends a first overdue notice at 30 calendar days and a final notice at 60 calendar days after the due date. The final notice states the amount due, how to resolve it and the deadline before any proposed suspension. Suspension is not automatic deletion; client-owned assets are preserved for handover. No undisclosed late fee applies.

Monthly care price increases require at least 60 days’ written notice and take effect at the start of a billing period after that notice. The client may cancel before the increase without an extra notice penalty or the higher rate. An agreed build price changes only through approved scope changes.

For business clients, either party may end care with one full billing month’s written notice beginning on the next renewal date. For example, notice on May 15 with a June 1 renewal ends service June 30. This is subject to cancellation rights that cannot be excluded by law. Hosting continues to the agreed end date, subject to lawful suspension. Arrange handover before services end. Retention is reviewed manually, with a target to remove service copies within 30 days after the agreed handover or service end, except records needed for legal, accounting or dispute purposes. This is not a promise of indefinite backup storage.

Email hello@fusionweb.ca. We check email regularly and aim to acknowledge within two business days, Monday to Friday excluding BC statutory holidays. Completion timing is confirmed separately. Mark core outages Urgent. There are no fixed office hours, immediate-response promise, continuous monitoring or uptime guarantee.

16External services and basic support

Third-party hosting, booking, payment and other services operate under their own terms, availability and fees. FusionWeb cannot guarantee their operation or prevent their outages. We can investigate basic connection or configuration issues within the agreed scope and explain when the provider or separately approved specialist work is needed. FusionWeb is not responsible for a failure caused solely by an external provider, but remains responsible for its own agreed work and obligations, subject to the liability terms and applicable law.

17Project information and customer records

FusionWeb may use client contact, business, project and hosting-configuration information to deliver and administer services, communicate with the client and improve its service and internal processes. FusionWeb does not sell personal information. Promotional messages are separate from necessary project communications and follow applicable consent and unsubscribe requirements.

Authorized employees and contractors, including those outside Canada, may receive information needed for assigned work under confidentiality and appropriate access arrangements. FusionWeb uses reasonable safeguards appropriate to the information and work; this agreement does not promise continuous security monitoring or that every possible security control is in place.

FusionWeb does not routinely access the client’s customer booking, order or enquiry records. Explicit client authorization for the specific task is required whether the client provides records directly or grants access to them in a system. Document the necessary records, instructions, access limits, safeguards and deletion arrangements. Customer details are not used for FusionWeb promotions. Temporary task copies have a manual deletion target within 30 days after the task, sooner if agreed, unless retention is legally required.

18AI-assisted work

FusionWeb may use AI-assisted tools to support design, development, content preparation and quality review, including preparation of project documents. FusionWeb remains responsible for reviewing the work. Client customer records, passwords, API keys and other sensitive information will not be entered into AI tools. Ordinary business and project information may be used where appropriate to the agreed work and applicable privacy obligations.

19Information incidents

If FusionWeb becomes aware of suspected or confirmed unauthorized access to, disclosure of or loss of the client’s personal information, it will notify the client promptly, share the information then known and provide updates as the response develops. FusionWeb will take reasonable steps to contain the incident and cooperate with the client’s response. Notices to individuals or authorities will be handled as required by law and coordinated where appropriate. This does not create a continuous monitoring service.

20Optional portfolio permission

The project agreement includes an optional, unchecked choice allowing FusionWeb to show the publicly launched website, business name and logo in its portfolio and promotion. Private information and customer data are excluded. Refusing permission does not affect service. Testimonials require separate permission.

Permission may be withdrawn by email. FusionWeb will stop new uses and remove displays it controls online as soon as reasonably practicable. Copies already distributed or independently held by third parties may not be recoverable.

21Liability limits

To the extent permitted by law, FusionWeb’s total aggregate liability arising from the website build is limited to the total agreed build price, including approved additions. Its total aggregate liability arising from ongoing care is separately limited to care fees actually paid during the three months preceding the event giving rise to the claim.

The applicable limit follows the service giving rise to the claim. A build claim is not reduced to the care limit merely because care was later purchased. Where a claim concerns both services, responsibility and the applicable limits are assessed for the relevant work; the same loss cannot be recovered twice.

To the extent permitted by law, FusionWeb is not liable for indirect or consequential losses, including loss of profit, revenue or business opportunities. These exclusions and limits do not apply to fraud, wilful misconduct, gross negligence or liability that cannot lawfully be excluded or limited. They do not reduce the refund or correction obligations expressly agreed in this document.

This limitation sets a maximum for covered compensation claims. It does not create an automatic refund entitlement or change the separately agreed cancellation and refund terms.

22Resolving concerns and governing law

Raise a concern in writing, explaining the issue and the desired outcome. Both parties will make reasonable efforts to resolve it through direct discussion. Mediation may be used by mutual agreement. This does not prevent urgent relief or restrict rights or remedies available under applicable law.

This agreement is governed by the laws of British Columbia and the applicable federal laws of Canada, subject to rights and requirements that cannot lawfully be excluded, including those applicable in the client’s province. This choice of law does not restrict FusionWeb to serving clients located in British Columbia.

23Email notices and agreed changes

Both parties consent to electronic communications. Approvals, change requests, cancellation and other contractual notices may be emailed to hello@fusionweb.ca and the client’s designated authorized representative at the address in this proposal. Notify the other party of contact changes. Decisions made by phone or video that affect scope, price or schedule must be confirmed in writing before action. Silence is not approval.

24Which documents apply

The accepted proposal or statement of work controls project scope, fees, deliverables, revisions and schedule. A project-specific provision prevails only on a conflicting point; the remaining terms continue. A later mutually approved written amendment prevails only for the matters it expressly changes. Updated public website terms do not automatically amend this agreement.

This agreement, the accepted proposal, expressly incorporated documents and subsequent mutually approved written amendments form the complete project agreement and replace earlier proposals, drafts and discussions on the same subject. Rights and remedies that cannot lawfully be excluded are preserved.

If any provision is found invalid or unenforceable, it will be ineffective only to the extent necessary. The remaining provisions continue to apply to the extent permitted by law.

25Electronic acceptance and change records

By signing, each party confirms that it accepts this agreement and the proposal identified above. Anyone signing on behalf of a business confirms that they have authority to bind that business. The parties agree that this agreement may be signed electronically. Each party will receive a copy of the completed agreement and its signing record.

Before signing, complete the client-specific scope, amounts, dates, priced stages and incorporated documents. Keep the exact completed agreement and signing record and provide both parties a copy. Signing the proposal does not authorize launch; launch approval is a separate written confirmation after review.

A written change record identifies the request and agreement version, added or removed deliverables, price and taxes, external costs, payment timing, revised dates and revision allowance. Both FusionWeb and the client’s named authorized representative approve it before additional work begins.
